Client was arrested and charged with sexual assault when his girlfriend was injured and taken to the hospital.
The police interviewed the girlfriend the next day and told her repeatedly that she had been sexually assaulted (which she never said). Months later, we were able to find out that Health and Human Services had interviewed the girlfriend just minutes before the police conducted their interview. During this interview, she told DHHS that she had been injured during consensual sex with her boyfriend. That report was in possession of the prosecution the entire time. We brought this to the court’s attention and forced the State to dismiss it’s case.
