Client Acquitted of Assault Charge

A client was breaking up a fight between his sister and his girlfriend. In the melee, his girlfriend stumbled backward and fell. In the fall, her neck landed on the exposed root of a maple tree, causing serious injury and permanent paralysis. The client was charged with assault.

At trial, we were able to convince the jury the incident was an accident and, therefore, no criminal liability should attach. The client was acquitted by the jury.
